Terms and Conditions – PH Spark Online Betting Platform

1Acceptance of Terms

Welcome to PH Spark. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Member," "User," or "you") and PH Spark ("the Platform," "we," "us," or "our"). By accessing the PH Spark website, registering an account, or placing a bet on any product offered by PH Spark, you confirm that you have read these Terms in full and that you unconditionally agree to be bound by them.

If you do not agree with any part of these Terms, you must not use the PH Spark platform. Continued use of the platform following any update to these Terms constitutes acceptance of the updated version. We recommend bookmarking this page and reviewing it periodically.

2Eligibility

To register and maintain an active account on PH Spark, you must meet all of the following eligibility requirements at all times:

• You must be at least 21 years of age. PH Spark strictly prohibits the use of its platform by minors. Where age is disputed, PH Spark reserves the right to request government-issued identification to confirm eligibility before processing any withdrawal.
• You must be a legal resident of the Philippines or accessing the platform from a jurisdiction where online betting is permitted under applicable local law.
• You must not be self-excluded from PH Spark or any other licensed gambling platform, whether voluntarily or by regulatory order.
• You must not be acting as an agent or proxy for a third party. Accounts must represent one real individual person — not a company, trust, or group account.
• You must not be a current employee of PH Spark, a related entity, or a service provider with access to non-public platform information.

3Account Registration

Each person is permitted to hold only one PH Spark account. Duplicate accounts, whether intentional or accidental, will be merged or closed. Bonuses claimed across duplicate accounts will be forfeited, and repeated violations may result in permanent suspension.

When registering your account, you agree to provide accurate, complete, and up-to-date information. This includes your legal name, date of birth, Philippine address, and active contact details. Providing false information during registration is a breach of these Terms and may result in immediate account termination.

You are solely responsible for maintaining the confidentiality of your login credentials. PH Spark will never ask for your password via email, live chat, or phone. All activity conducted under your account — whether authorised by you or not — remains your responsibility until you notify PH Spark of any unauthorised access.

• Use a strong, unique password for your PH Spark account.
• Enable two-factor authentication (2FA) for additional security where available.
• Log out of your account when using shared or public devices.
• Notify support@phspark.app immediately if you suspect your account has been compromised.

4Identity Verification (KYC)

PH Spark is required by applicable Philippine regulations to verify the identity of all members before processing withdrawals above certain thresholds, and in certain other circumstances. This Know Your Customer (KYC) process requires you to submit copies of valid government-issued identification documents.

Acceptable Philippine identification documents include: PhilSys National ID, Passport, Driver's Licence, SSS/GSIS ID, PRC ID, UMID, or Voter's ID. PH Spark may request additional documents (such as a recent utility bill as proof of address) at its discretion.

Failure to complete KYC verification within 14 days of a request will result in your withdrawal being held. Accounts where KYC cannot be satisfactorily completed may be suspended and balances held pending investigation. PH Spark aims to process all submitted KYC documents within 2 business days.

5Deposits & Payments

PH Spark accepts deposits via the following payment methods available to Philippine residents:

All deposits must be made from payment accounts or cards registered in your own name. Third-party deposits are not permitted. Deposits using payment methods not registered to the account holder may be reversed and the account reviewed for compliance.

PH Spark does not charge fees for deposits; however, your payment provider may impose their own transaction fees. PH Spark is not responsible for fees charged by third-party payment providers. Deposits are credited to your PH Spark balance in Philippine Pesos (₱) only.

6Withdrawals

PH Spark processes withdrawal requests to the same payment method used for the corresponding deposit (same-source withdrawal policy). Where the original deposit method is no longer available, PH Spark support will assist in arranging an alternative verified withdrawal channel.

Standard withdrawal processing times are as follows:

• GCash and Maya: Within 10 minutes during standard operating conditions, 24 hours a day.
• Bank Transfer (InstaPay): Up to 2 business hours during banking hours.
• Visa / Mastercard: 1–3 business days, subject to issuing bank processing times.

Minimum withdrawal amount is ₱200. PH Spark does not charge withdrawal fees on standard requests. Members are permitted up to 5 withdrawal requests per 24-hour period. Requests exceeding this limit will be queued for the following day.

Withdrawals will not be processed until any active bonus wagering requirements attached to deposited funds have been fully met. PH Spark reserves the right to conduct additional identity verification checks before processing large withdrawals or withdrawals that follow unusual account activity patterns.

7Bonuses & Promotions

PH Spark offers a range of bonuses and promotional offers to eligible members. All bonuses are subject to the specific terms published on the PH Spark Promotions page at the time the bonus is claimed, in addition to the following general bonus conditions that apply across all offers:

• Bonuses are available to members who meet the stated eligibility criteria. New member bonuses are only available to accounts that have not previously held a PH Spark account.
• Wagering requirements must be met in full before any bonus-derived winnings can be withdrawn. The applicable wagering multiplier is stated on each individual promotion.
• Bonuses that are not used within their stated validity period will expire and be removed from the member's account automatically.
• PH Spark reserves the right to withdraw, modify, or cancel any promotion at any time. Members who have already opted in and partially completed wagering will be treated on a case-by-case basis.
• Bonuses may not be combined unless PH Spark's promotion terms explicitly state otherwise.
• Any attempt to abuse the bonus system — including but not limited to matched betting using bonus funds, account duplication to claim multiple welcome bonuses, or betting on outcomes that cover all possibilities to guarantee profit — will result in bonus forfeiture and may result in account termination.
• Free bets do not include the stake in winnings. If a ₱200 free bet wins at odds of 2.00, the return is ₱200 (the winnings only), not ₱400.

8Betting Rules

All bets placed on PH Spark are subject to the following general betting rules. Sport-specific and market-specific rules may supplement these where stated in the individual market descriptions on the platform.

• Bet acceptance: A bet is accepted when PH Spark confirms it via a bet reference number displayed in your account's bet history. Bets remain "pending" until confirmed — do not assume a bet is active until you see the confirmation.
• Odds changes: PH Spark offers odds at the time of bet placement. Once a bet is confirmed, the accepted odds are locked regardless of subsequent market movement.
• Minimum and maximum stakes: The minimum stake per bet is ₱20. Maximum stakes vary by market and event. PH Spark reserves the right to limit maximum stake sizes at its discretion for any market, event, or individual account.
• Void bets: A bet may be voided if the event is cancelled, abandoned, or if the market was opened in error (e.g., incorrect odds due to a data feed issue). Voided bets have the stake returned in full to the member's wallet.
• Result disputes: In the event of a disputed result, PH Spark will hold settlement until the official result is confirmed by the relevant governing body or tournament organiser. PH Spark's decision on the final result, based on official sources, is final.
• Parlays: If any leg of a parlay is voided, that leg is treated as a non-runner and the parlay is recalculated without it. If only one qualifying leg remains after voids, the parlay becomes a single bet at the remaining selection's odds.

9Live / In-Play Betting

PH Spark offers live in-play betting on selected sports and esports markets. The following additional rules apply to all in-play bets placed on PH Spark:

• In-play odds are updated continuously. PH Spark may suspend markets at any time during an event to manage risk or update odds following significant match events. Bets submitted during a suspension period will not be accepted and the stake will be returned.
• PH Spark is not responsible for delays between real-world events and their reflection in live betting odds caused by stream latency, data feed delays, or network issues. Bets placed with knowledge of an already-occurred event not yet reflected in the odds may be voided at PH Spark's discretion.
• If a match is temporarily suspended and later resumed, all in-play bets placed before the suspension remain active and will be settled on the final result unless the event is subsequently abandoned.
• In the event of an extended interruption (more than 48 hours), all unsettled in-play bets on affected matches will be voided and stakes returned.

10Esports Betting Rules

Esports betting on PH Spark covers Mobile Legends: Bang Bang (MPL PH and international events), DOTA 2, Valorant, CS2, League of Legends, and other titles as added to the platform. The following rules apply in addition to the general betting rules in Section 8:

• Match cancellations: If a scheduled esports match is cancelled before it begins, all bets on that match are voided and stakes returned.
• Technical pauses: If a game within a series is paused due to a technical issue and replayed from scratch, bets on that individual game are voided. Series-level bets remain active.
• Map/game winner bets: Settled on the official result confirmed by the tournament organiser. If a team forfeits mid-game, the opposing team is deemed the winner.
• Correct score markets: Settled on the final confirmed series score. If a series ends early due to a team withdrawal or disqualification, the result at the point of withdrawal is used for settlement.
• Player prop markets: If a player is substituted before the relevant market is resolved, the bet may be voided at PH Spark's discretion depending on the nature of the substitution and its impact on the market.

11Live Casino Rules

Live casino games on PH Spark are operated by licensed third-party game providers. All live casino games — including baccarat, roulette, blackjack, and game shows — are subject to the game rules displayed within the live casino interface and the terms of the relevant third-party provider.

In the event of a technical failure during a live casino round (including disconnection from the game server), the round will be settled based on the result recorded by the game provider's server. PH Spark is not responsible for results affected by the member's own internet connection or device failure. Bets that were not confirmed by the game server before a disconnection will be voided and stakes returned.

12Prohibited Conduct

The following activities are strictly prohibited on PH Spark and will result in account suspension, permanent termination, and forfeiture of funds where applicable:

• Registering more than one account on PH Spark, whether under the same or different names, contact details, or device identifiers.
• Providing false, misleading, or third-party identity information during registration or KYC verification.
• Using the platform to launder funds or facilitate any activity related to money laundering, fraud, or financial crime.
• Using any form of automated software, bots, scripts, or artificial intelligence tools to interact with the platform, monitor odds, or place bets without human initiation.
• Exploiting errors in odds, software bugs, or platform malfunctions for financial gain. Any winnings derived from a known or suspected platform error may be voided and the relevant amounts reclaimed from the member's balance.
• Colluding with other bettors to manipulate markets, share match-fixing information, or guarantee arbitrage profits through coordinated betting activity.
• Attempting to access PH Spark systems, databases, or member accounts through unauthorised means.
• Harassing, threatening, or abusing PH Spark staff or other members via any communication channel.

PH Spark may report suspected illegal activities — including fraud and money laundering — to relevant Philippine law enforcement and financial regulatory authorities. Members are reminded that all transactions on PH Spark are subject to monitoring for compliance with Philippine anti-money laundering laws.

13Account Suspension and Termination

PH Spark reserves the right to suspend or permanently close any account at its discretion, with or without prior notice, in the following circumstances:

• Breach of any provision of these Terms and Conditions.
• Failure to complete KYC verification within the required timeframe.
• Fraudulent activity, suspected identity theft, or attempted use of stolen payment credentials.
• Requests from regulatory authorities or law enforcement.
• Extended account inactivity (12+ months with no login or transaction activity).

Where an account is closed due to a breach of these Terms, any remaining balance may be withheld pending investigation. Where no breach is found, the verified account balance will be returned to the member's registered payment method within 10 business days. Disputed closures may be raised with our support team at support@phspark.app.

Members may also close their own account at any time by contacting PH Spark support. Account closure requests will be processed within 48 hours. Before closing, any pending bets will be settled normally and the final verified balance returned via the standard withdrawal process.

14Responsible Gaming

PH Spark is genuinely committed to responsible gaming — not just as a regulatory obligation but as a core part of how the platform operates. Betting is entertainment, and PH Spark takes seriously its responsibility to ensure it remains that way for every member.

PH Spark provides the following responsible gaming tools to all verified members, accessible directly from the account settings page:

• Deposit limits: Set daily, weekly, or monthly limits on how much you can deposit. Reductions take effect immediately; increases take 7 days to activate.
• Loss limits: Set limits on how much you can lose in a defined period. Loss limits function the same way as deposit limits.
• Session time limits: Receive automatic notifications when you have been logged in for a specified duration.
• Cool-off periods: Take a temporary break from betting for 1 day, 7 days, or 30 days. During a cool-off period your account remains open but betting is disabled.
• Self-exclusion: Permanently or temporarily exclude yourself from PH Spark. Self-exclusion requests are processed immediately and cannot be reversed for a minimum of 6 months.

15Privacy & Data Protection

PH Spark collects and processes personal data in accordance with its Privacy Policy and the Data Privacy Act of 2012 (Republic Act 10173). By using PH Spark, you consent to the collection and processing of your personal data as described in the Privacy Policy.

PH Spark will never sell, rent, or share your personal data with third parties for marketing purposes. Data may be shared with payment processors, identity verification providers, and regulatory bodies only where strictly necessary and in accordance with applicable law. All third-party data processors engaged by PH Spark are required to maintain the same standard of data protection.

16Limitation of Liability

PH Spark provides the platform on an "as is" and "as available" basis. To the maximum extent permitted by applicable Philippine law, PH Spark excludes all warranties, express or implied, in connection with the platform and your use of it. PH Spark does not warrant that the platform will be error-free, uninterrupted, or free from technical issues at all times.

PH Spark shall not be liable for any indirect, consequential, incidental, or punitive losses arising out of your use of the platform, including but not limited to loss of winnings due to platform downtime, data loss, or force majeure events. PH Spark's total cumulative liability to any individual member in any 12-month period shall not exceed the total amount deposited by that member in the same period.

Nothing in these Terms limits PH Spark's liability for death or personal injury arising from its negligence, or for any other liability that cannot be excluded under Philippine law.

17Amendments to These Terms

PH Spark reserves the right to amend, update, or replace these Terms at any time. When material changes are made, PH Spark will notify members via email to the registered address and/or a prominent notice on the platform at least 7 days before the changes take effect.

Continued use of PH Spark after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the platform and contact support to close your account and withdraw your balance before the effective date.

The "Last Updated" date shown at the top of this document reflects the date of the most recent revision. Members are encouraged to review these Terms periodically, particularly before placing bets following a significant period of inactivity.

18Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

Before initiating formal legal proceedings, members are encouraged to contact PH Spark's support team to attempt to resolve the dispute informally. PH Spark is committed to handling member complaints fairly and promptly. If a complaint cannot be resolved internally, members may also seek recourse through relevant Philippine consumer protection authorities.

In the event that any provision of these Terms is found to be unenforceable or invalid under Philippine law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible, without affecting the remaining provisions.
